  • Your data will remain restricted and accessibility locked using secure networks, systems and accounts. You have a number of rights with regard to your personal data. These include:

Our Governance

  • We recognise the importance of upholding high standards of ethics and professionalism to ensure the safety and well-being of our clients, and have implemented various policies and procedures to monitor and support our practitioners throughout their journey with us, while our practitioners are also subject to further requirements from universities, regulatory bodies, accreditation requirements and clinical/academic supervisory input:

    • Practitioners are subject to the policies and procedures of MyProTherapies. We monitor our practitioners closely to ensure that they are meeting these requirements and that they are providing high-quality therapy services to our clients. √

    • MyProTherapies provides practioners with guidance on our policies and procedures to ensure that they understand and follow them. We also monitor the quality of therapy services provided by our practitioners through regular reviews and feedback from clients. √

    • All of our practitioners have membership/accredited status within professional bodies/regulatory organizations except a small minority of practitioners still working towards this. This requires them to adhere to specific standards, requirements, and practices. √

    • Any of our practitioners who are still completing a training are subject to the policies, procedures, standards, and codes of ethics of their course provider, academic supervisors, and clinical supervisors where appropriate. √

    • Universities have thorough placement/practice guidance for practitioners with trainee status, while academic supervisors in many instances will also themselves be fully accredited and certified therapists, who will meet any trainee practitioners at regular intervals. √

    • Clinical supervisors are accredited therapists, whom have undergone continuing professional training to attain supervisory status. They advise, guide and facilitate any practitioners who are still in training, through regular 1-2-1 meetings, in their clinical practice, to ensure the respective professional body is being adhered to, and to ensure safety and risk standards are being met, for practice accreditation requirements. √

  • The Site General Terms and Conditions

    The following are the Terms and Conditions (the "Agreement") which govern your access and use of our online platform through which therapy/counselling/support may be provided (collectively the "Platform"). This website is owned and operated by Myprotherapies. The Platform may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties, including, without limitation, the website Myprotherapies.com and its related apps.

    By accessing or using the Platform, you are entering into this Agreement. You should read this Agreement carefully before starting to use the Platform. If you do not agree to be bound to any term of this Agreement, you must not access the Platform.

    When the terms "we", "us", "our" or similar are used in this Agreement, they refer to any company that owns and operates the Platform (the "Company").

    • The Therapists/Counselling and Therapist/Counselling Services

    The Platform may be used to connect you with a Therapist/Counsellor who will provide services to you through the platform ("Therapist Services").

    • For U.K. based Therapists/Counsellors

    We require minimum higher level education/Level Three/Four Professional Training and confirmation/evidence of studying therapy/Counselling at a higher education/Professional Training level for consideration of being registered with our platform, therapists will need to have achieved a 2:1/first classification in their degree at undergraduate level and provide evidence of clinical supervision with an appropriately accredited and trained supervisor, who will be responsible for supervising their clinical practice, or at bare minimum demonstrate they are on course for a 2:1.

    • For all Therapists/Counsellors (collective termed “service providers”) , and service users.

    Service Providers are independent providers who are neither our employees nor agents nor representatives. The Platforms role is limited to enabling the Services. The Service Providers themselves are responsible for the performance of the services. If you feel the services provided by the service provider does not fit your needs or expectations, you may change to a different service provider who provides services through the Platform. While we have a significant database of Service Providers. If a Service Provider you have been connected with stops using the Platform at any time after you have been connected, we will send an email to notify you that your Service Provider is no longer on the Platform and that you have the opportunity to match with a new Service Provider.

    While we hope the services are beneficial to you, you understand, agree and acknowledge that they may not be the appropriate solution for everyone's needs and that they may not be appropriate for every particular situation and/or may not be a complete substitute for a face-to-face examination and/or care in every particular situation.

    IF YOU ARE THINKING ABOUT SUICIDE OR IF YOU ARE CONSIDERING HARMING YOURSELF OR OTHERS OR IF YOU FEEL THAT ANY OTHER PERSON MAY BE IN ANY DANGER OR IF YOU HAVE ANY MEDICAL EMERGENCY, YOU MUST IMMEDIATELY CALL YOUR LOCAL EMERGENCY SERVICES NUMBER AND NOTIFY THE RELEVANT AUTHORITIES. THE PLATFORM IS NOT DESIGNED FOR USE IN ANY OF THE AFOREMENTIONED CASES AND THE THERAPISTS/CHAMPIONS CANNOT PROVIDE THE ASSISTANCE REQUIRED IN ANY OF THE AFOREMENTIONED CASES.

    THE PLATFORM IS NOT INTENDED FOR THE PROVISION OF CLINICAL DIAGNOSIS REQUIRING AN IN-PERSON EVALUATION AND YOU SHOULD NOT USE IT IF YOU NEED ANY OFFICIAL DOCUMENTATION OR APPROVALS FOR PURPOSES SUCH AS, BUT NOT LIMITED TO, COURT-ORDERED THERAPY. IT IS ALSO NOT INTENDED FOR ANY INFORMATION REGARDING WHICH DRUGS OR MEDICAL TREATMENT MAY BE APPROPRIATE FOR YOU, AND YOU SHOULD DISREGARD ANY SUCH ADVICE IF DELIVERED THROUGH THE PLATFORM.

    DO NOT DISREGARD, AVOID, OR DELAY IN OBTAINING IN-PERSON CARE FROM YOUR DOCTOR OR OTHER QUALIFIED PROFESSIONAL BECAUSE OF INFORMATION OR ADVICE YOU RECEIVED THROUGH THE PLATFORM.

    • Privacy and Security

    Protecting and safeguarding any information you provide through the Platform is extremely important to us. Information about our security and privacy practices can be found under the section marked ‘privacy policy’ on the page ‘Safety - Quality - Compliance’.

    BY AGREEING TO THIS AGREEMENT AND/OR BY USING THE PLATFORM, YOU ARE ALSO AGREEING TO THE TERMS OF THE PRIVACY POLICY. THE PRIVACY POLICY IS INCORPORATED INTO AND DEEMED A PART OF THIS AGREEMENT. THE SAME RULES THAT APPLY REGARDING CHANGES AND REVISIONS OF THIS AGREEMENT ALSO APPLY TO CHANGES AND REVISIONS OF THE PRIVACY POLICY.

    • Third Party Content

    The Platform may contain other content, products or services which are offered or provided by third parties ("Third Party Content"). Links to Third Party Content (including but not limited to links to other websites) or advertisements which are related to Third Party Content. We have no responsibility for the creation of any such Third Party Content, including (but not limited to) any related products, practices, terms or policies, and we will not be liable for any damage or loss caused by any Third Party Content.

    • Disclaimer of Warranty and Limitation of Liability:

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY NATURE RESULTING FROM THE SERVICES OR THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE OF ANY SERVICE PROVIDER AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM.

    YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM IS PROVIDED "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, NON-INFRINGEMENT, SECURITY, FITNESS FOR A PARTICULAR PURPOSE OR ACCURACY. THE USE OF THE PLATFORM IS AT YOUR OWN RISK. TO THE FULLEST EXTENT OF THE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED.

    YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT WE SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES.

    YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT OUR AGGREGATE LIABILITY FOR DAMAGES ARISING WITH RESPECT TO THIS AGREEMENT AND ANY AND ALL USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU OR ON YOUR BEHALF THROUGH THE PLATFORM IN THE 12 MONTHS PERIOD PRIOR TO THE DATE OF THE CLAIM.

    You will indemnify, defend, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys' fees and expenses) arising out of or relating to any of the following:

    (i) your access to or use of the Platform;

    (ii) your use of the Services;

    (iii) any actions made with your account whether by you or by someone else;

    (iv) your violation of any of the provisions of this Agreement;

    (v) non-payment for any of the services (including Services) which were provided through the Platform;

    (vi) your violation of any third party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right.

    In the event of any problem with the Platform or any of its content, your sole remedy shall be to cease using the Platform. Under no circumstances shall the Company, any of the Company’s licensor or supplier, or any third party who promotes the Platform or provides you with a link to the Platform be liable in any way for your use of the Platform or any of its content, including, but not limited to, any errors or omissions in any content, any infringement by any content of the intellectual property rights or other rights of third parties, or for any loss or damage of any kind incurred as a result of the use of any content.

    Under no circumstances shall the Company, its licensors or suppliers of non-medical/ mental healthcare services or any third party who promotes the Platform or provides you with a link to the Platform, be liable for any punitive, exemplary, consequential, incidental, indirect or special damages (including, but not limited to, personal injury, lost profits, business interruption, loss of programs or other data on your computer or otherwise) arising from or in connection with your use of the Platform, whether under a theory of breach of contract, negligence, strict liability, malpractice or otherwise, even if the Company or any third party have been advised of the possibility of such damages.

    The Company shall not be liable to you or to any third party for any indirect, incidental, consequential, special, punitive or exemplary damages.

    The Company’s aggregate liability for damages arising with respect to the Terms and Conditions and any use of the Platform will not exceed the total amount of money paid by you or on your behalf through the platform in the 3 (three) months period prior to the date of the claim.

    You shall release and hold the Company harmless for all causes of actions and claims resulting from the Services or the Platform, such as but not limited to acts, omissions, opinions, responses, advices, suggestions, information and or service of any Counsellor and/or any other content or information accessible through the Platform.

    If applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.

    This section (limitation of liability) shall survive the termination or expiration of this Agreement.

    • Your Service Booking

    We offer different service options that you can choose; all include billing before booking. Any type of service you choose will be refunded only if you cancel the service’s occurrence. By choosing a paid service, you acknowledge that such paid services are and can be billed before or after they occur and you accept cancellations can only be made over twenty four hours before the occurrence.

    Your service must be cancelled twenty four hours prior to it’s occurrence in order to avoid being charged.

    Free Trials: Occasionally, we offer free trials for our Services. Once a free trial expires, only the paid service will be available to you.

    • Your account, representations, conduct and commitments

    You hereby confirm that you are legally able to consent to receive Services, and are legally able to enter into a contract.

    You hereby confirm and agree that all the information that you provided in or through the Platform, and the information that you will provide in or through the Platform in the future, is accurate, true, current and complete. Furthermore, you agree that during the term of this Agreement you will make sure to maintain and update this information so it will continue to be accurate, current and complete.

    You agree, confirm and acknowledge that you are responsible for maintaining the confidentiality of your password and any other security information related to your account (collectively "Account Access"). We advise you to change your password frequently and to take extra care in safeguarding your password.

    You agree to notify us immediately of any unauthorized use of your Account Access or any other concern for breach of your account security.

    You agree, confirm and acknowledge that we will not be liable for any loss or damage that incurred as a result of someone else using your account, either with or without your consent and/or knowledge.

    You agree, confirm and acknowledge that you are solely and fully liable and responsible for all activities performed using your Account Access. You further acknowledge and agree that we will hold you liable and responsible for any damage or loss incurred as a result of the use of your Account Access by any person whether authorized by you or not, and you agree to indemnify us for any such damage or loss.

    You agree and commit not to use the account or Account Access of any other person for any reason.

    You agree and confirm that your use of the Platform, including the Services, are for your own personal use only and that you are not using the Platform or the Therapist Services for or behalf of any other person or organization.

    You agree and commit not to interfere with or disrupt, or attempt to interfere with or disrupt, any of our systems, services, servers, networks or infrastructure, or any of the Platform's systems, services, servers, networks or infrastructure, including without limitation obtaining unauthorized access to the aforementioned.

    You agree and commit not to make any use of the Platform for the posting, sending or delivering of either of the following: (a) unsolicited email and/or advertisement or promotion of goods and services; (b) malicious software or code; (c) unlawful, harassing, privacy invading, abusive, threatening, vulgar, obscene, racist or potentially harmful content; (d) any content that infringes a third party right including intellectual property rights; (e) any content that may cause damage to a third party; (f) any content which may constitute, cause or encourage a criminal action or violate any applicable law.

    You agree and commit not to violate any applicable local, county, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the Platform and your relationship with the Therapists/Champions and us.

    If you receive any file from us or from a Therapist, whether through the Platform or not, you agree to check and scan this file for any virus or malicious software prior to opening or using this file.

    You will indemnify us, defend us, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys' fees and expenses) arising out of or relating to any of the following: (a) your access to or use of the Platform; (b) any actions made with your account or Account Access whether by you or by someone else; (c) your violation of any of the provisions of this Agreement; (d) non-payment for any of the services (including Therapist/Champion Services) which were provided through the Platform; (e) your violation of any third party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall survive expiration or termination of this Agreement.

    You confirm and agree to use only credit cards or other payment means (collectively "Payment Means") which you are duly and fully authorized to use, and that all payment related information that you provided and will provide in the future, to or through the Platform, is accurate, current and correct and will continue to be accurate, current and correct.

    You agree to pay all fees and charges associated with your Account on a timely basis and according to the fees schedule, the terms and the rates as published in the Platform. By providing us with your Payment Means you authorize us to bill and charge you through that Payment Means and you agree to maintain valid Payment Means information in your Account information.

    • Modifications, Termination, Interruption and Disruptions to the Platform

    You understand, agree and acknowledge that we may modify, suspend, disrupt or discontinue the Platform, any part of the Platform or the use of the Platform, whether to all clients or to you specifically, at any time with or without notice to you. You agree and acknowledge that we will not be liable for any of the aforementioned actions or for any losses or damages that are caused by any of the aforementioned actions.

    The Platform depends on various factors such as software, hardware and tools, either our own or those owned and/or operated by our contractors and suppliers. While we make commercially reasonable efforts to ensure the Platform's reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible and so we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible, consistent, timely or error-free at all times.

    • Notices

    We may provide notices or other communications to you regarding this agreement or any aspect of the Platform, by email to the email address that we have on record, by regular mail or by posting it online. The date of receipt shall be deemed the date on which such notice is given. Notices sent to us must be delivered by email to contact@myprotherapies.co.uk

    • Important notes about our Agreement

    This Agreement and our relationship with you shall both be interpreted solely in accordance with the laws of England, as part of the United Kingdom of Britain and Northern Ireland, excluding any rules governing choice of laws.

    THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND US. YOU CONFIRM THAT YOU HAVE NOT RELIED UPON ANY PROMISES OR REPRESENTATIONS BY US EXCEPT AS SET FORTH IN THIS AGREEMENT.

    We may change this Agreement by posting modifications on the Platform. Unless otherwise specified by us, all modifications shall be effective upon posting. Therefore, you are encouraged to check the terms of this Agreement frequently. The last update date of this Agreement is posted at the bottom of the Agreement. By using the Platform after the changes become effective, you agree to be bound by such changes to the Agreement. If you do not agree to the changes, you must terminate access to the Platform and participation in its services.

    We may freely transfer or assign this Agreement or any of its obligations hereunder.

    The paragraph headings in this Agreement are solely for the sake of convenience and will not be applied in the interpretation of this Agreement.

    If any provision of this Agreement is held by a court of competent jurisdiction to be illegal, invalid, unenforceable, or otherwise contrary to law, the remaining provisions of this Agreement will remain in full force and effect.

    To clear any doubt, all clauses regarding limitations of liabilities and indemnification shall survive the termination or expiration of this Agreement.

  • Myprotherapies Safeguarding Policy and Procedure

    Introduction

    This safeguarding policy and procedure outlines the measures that myprotherapies takes to ensure the safety and protection of our service users. We have implemented procedures to support providers in their work and ensure that they meet the industry standards expected of them.

    Recruitment and Training

    All Providers must undergo a rigorous recruitment process, which includes the following:

    A comprehensive application form, including questions about the provider’s relevant experience, qualifications, and background.

    A face-to-face interview, which includes questions about the provider’s safeguarding knowledge and understanding.

    Reference checks, including verification of any relevant qualifications and confirmation of the provider’s suitability to work with vulnerable adults.

    Clinical Supervision checks, ensuring trainee’s have a clinical supervisor who meets industry standards and criteria, who is associated and verified by the professional body they are working toward.

    Communication and Record-Keeping

    All communication between providers and users must take place through our secure online platform or in exceptional circumstances via direct email. Providers are not permitted to communicate with users via phone or any other method outside of the platform.

    Risk Assessment and Management

    All Providers must complete an ongoing risk assessment for each user accessing services. This assessment should consider any safeguarding risks associated with the users’ age, vulnerabilities, and mental health. Where appropriate, providers must discuss any concerns they have with their clinical supervisor.

    In the event of a safeguarding concern, providers are to follow their respective reporting procedures, which may include reporting the concern to their clinical supervisor immediately or contacting relevant authorities. Providers must also document the concern with Myprotherapies, including details of any action taken.

    Supervision and Support

    Practitioners who are trainees receive regular supervision from a qualified supervisor. This supervision includes a review of the trainees’ work, discussion of any concerns or issues, and feedback on their performance.

    Review and Monitoring

    We regularly review our safeguarding policy and procedures to ensure that they remain effective and up-to-date. We also monitor our providers to ensure they meet the required standards of practice and professionalism, of myprotherapies. Any concerns or issues are addressed immediately, and appropriate action is taken.

    Conclusion

    Our safeguarding policy and procedure reflects our commitment to ensuring the safety and protection of our users, particularly vulnerable adults. We believe that we can provide an excellent service while supporting existing and new practitioners.

    By implementing these procedures, we aim to maintain the highest standards of practice and professionalism while protecting the welfare of those who use our services.

  • Myprotherapies Risk Management Policy and Procedure

    Introduction

    This risk management policy and procedure outlines the measures that Myprotherapies takes to manage and mitigate risks associated with our services, particularly those associated with the use of trainees to deliver therapy services. Our aim is to facilitate a safe and secure environment for our Users and Providers, for the delivery of high-quality services.

    Risk Assessment

    We have, and continue to, undertake comprehensive risk assessments of our services, including the use of trainees, to identify potential risks and their likelihood and impact. This assessment includes the following areas:

    Cybersecurity: We ensure that our platform and user/provider data are secure to from external threats, such as hacking or data breaches, and do not store user/provider information that is private, other than for admin/login purposes.

    Confidentiality: We ensure that our clients' personal and sensitive data are kept confidential and our trainees in the process of becoming accredited are bound by their respective strict confidentiality policies.

    Safeguarding: We identify and manage risks associated with the safeguarding of vulnerable adults, insofar as we deem our service is not suitable for vulnerable adults, due to the associated complexities, and will politely refuse them from our services where this is identified in assessment. If by human error, this is not adhered to and a vulnerable adult is assigned a service. It is the responsibility of the service provider in conjunction with their clinical supervisor to identify their unsuitability and not Myprotherapies as we cannot guarantee over the course of assessment (30 minutes) that all vulnerable adults will be successfully identified and screened out.

    Training and Competence: We use our five step registration process, including interview and supporting document verification, to ensure that our trainees are what they say they are.

    Professionalism: We ensure that our trainees meet the required standards of professionalism, ethics, and conduct, of the professional body they aspire to join, in line with the industry standard being set.

    Risk Mitigation Strategies

    We implement the following risk mitigation strategies to manage and reduce the risks associated with our services:

    Cybersecurity: We use secure online platforms and software to protect our clients' data from external threats. We also have strict access controls to limit the number of people who can access this data.

    Confidentiality: Providers and their supervisors will have strict confidentiality policies and procedures in place. We also ensure that our trainees understand the importance of confidentiality and the potential consequences of breaches.

    Safeguarding: Providers will have a clear safeguarding pathway as dictated by their supervision, course and professional bodies. We may document any safeguarding concerns for our internal admin compliance however it is the responsibility of the provider to report/defer this onward.

    Training and Competence: We carry out thorough checks and verification on our providers to ensure they are adequately trained and competent to deliver the relevant services, as well as internal trainings.

    Professionalism: We have a high standard for our providers and regularly turn providers away who do not meet our standard in terms of ethics and conduct. We also have a process in place for managing any breaches of good practice, in line with industry standards and the standards of their respective bodies, courses, supervisory input.

    Incident Management

    In the event of any incidents or breaches, we have a clear incident management procedure in place. This procedure includes the following steps:

    Identification: identify the nature and scope of the incident or breach.

    Containment: We take immediate action to contain the incident or breach and prevent further damage or harm.

    Reporting: We report the incident or breach to relevant parties, such as clients, regulatory bodies, and law enforcement if necessary.

  • GDPR and Data Protection Policy for Myprotherapies

  • Booking/Payment Policies for Myprotherapies

    Introduction

    Our online therapy platform is committed to providing high-quality therapy services to our clients. This policy outlines our approach to booking and payment, including our cancellation and refund policy.

    Booking

    Users can book therapy sessions through our online booking system. Payment is required at the time of booking to secure the appointment. We accept payment through credit/debit cards.

    Cancellation and Rescheduling

    Service users can cancel or reschedule their appointments up to 24 hours before the scheduled session. If users cancel or reschedule within 24 hours of the scheduled session, they will be charged the full fee for the session. Users can cancel or reschedule their appointments through our online booking system or by contacting our customer service help email.

    Refund

    We do not offer refunds for cancelled or missed appointments, except in exceptional circumstances, such as illness or bereavement. If a user believes that they have exceptional circumstances that justify a refund, they should contact our customer service help email to discuss their situation. Any decision to offer a refund will be at our discretion.

    Late Arrival

    If a user arrives late for their scheduled session, the session will still end at the scheduled time, and the client will be charged the full fee for the session.

    No Show

    If a user does not attend their scheduled session without prior notice, they will be charged the full fee for the session.

    In the rare event that a provider is unable to attend due to exceptional circumstances a full refund will be made.

    If you are a user of Myprotherapies service providers, we are offering £18 if you refer another user who books a free assessment and follows up with a paid service with one of our providers. This will be refunded to your paying account. All they have to do is email us your full name and email, once they’ve received a paid service from one of our providers.

    Referring a Provider!

    If you are a Therapist/Champion, and refer another provider to Myprotherapies, we are offering £30, once they have onboarded and provided paid services to a minimum of three users. All they have to do is email us your full name and email, once they’ve provided paid services to three users, and this will be added to your monthly pay.

    Affiliate Scheme

    If you are interested in becoming one of our official affiliates, contact us today to get your unique affiliate code and start earning up to £18 per referral, which can be inputted into users sign on form, and will be activated and released should they exceed a full, paid service with one of our providers.
